Developments in technology are in all parts of our lives. We are travelling into times where anything we need would be offered in cellular phones. But there is another thing with no limits; new crimes triggered by new technologies. Crimes executed via internet shows us how necessary it is to consider the relations between law and the internet.

In the morning, you are awaken by the alarm of your cellular phone. You will go to work, but you receive an SMS telling the weather would be rainy during the day. And another SMS, now you know there is a traffic jam on the highway to work. After receiving this information you decide taking the marine trasnportation instead of driving. During your travel, you first check your e-mail via your cellular phone. Then do a little research about the meeting you will attend or read a book.

You are experiencing some legal issues. You need to consult to a lawyer immediately but you are overloaded with work and cannot allocate time. From the internet you found yourself a lawyer and directed your questions to him/her over the cellular phone. You made the payment via your cellular phone and had the invoice issued to your name. You use online consulting services not only in law, but in many areas including finance and health as well.

Your mother has heartbeat disorder. You would like to have her under constant control. But how? The only necessary thing to do is to locate some sensors on her body. Information passed to cellular phone is then transferred to doctors. Thus all symptoms and information about the disorder is under control. Now there is chance for immediate intervention.

The concept of "being mobile" is in all aspects of our lives. But don't assume that is all about innovation... According to a study performed by HP, by 2010 all public units and services will be accessible via mobile mediums. This means mobile state will be a portable service and all applications will be carried to cellular phones. Thus we will be saving time and costs.

According to Bill Gates' foresight about the internet: "In 5 years half of the people will read their newspapers on the internet". Of course this is not only related to newspapers. Electronic book readers in USA is rapidly increasing. In the last quarter of 2004, 420.000 e-books were sold in USA. The revenues from these sales is approximately USD 3.5 million. The estimation of revenues from e-books sales in 2005 is over USD 250 million. And this equals to regular book sales' revenues in Turkiye.

Internet continues to expand. All sectors have adapted to the internet channel. Music, movies, books are downloaded from the internet and listened to, watched and read. Internet access rates are approximately 10% throughout the world. That is also true for Turkiye. However, cellular phone usage rate has reached 40%. Nowadays, internet and cellular services are binded together. The path is innovating devices with multiple uses and various features. While concepts are within one another, individuals are enjoying the comfort of offered services. Technology is developing very fast. Pace of the implementation of legal regulations in Turkiye is falling far behind this development. Recently the media was flooded with news relating to the same subject. A video file captured with no consent, basically invasion of privacy by capturing graphic nudity, was the subject on all newspapers and TV channels, since the participants were also famous public figures. With this happening, relations of law and technology once more was on the headlines. It was absolute that new regulations are required.

Another subject also came up. Every month Google presents the statistics of searches on its search engine. It classifies searches according to countries, and presents the top 10-15 words searched at its search engine. One of the top 5 words in the month September is "Gamze Özcelik". In this case, the question is if Google link to original site of the video file or the forum that distributed the file. When other search engines are also considered, we do not have exact information on how many times this name was searched on the search engines, and at what rate this video was distributed.

It is not yet clear if reaching such links from search engines is a crime or not, there is no clear approach. How responsible the search engines are? Which country's legal authorities will be dealing with the issue, since they are foreign companies? Occurance of the event is a crime, but what about distribution? Distributors of the movie file and the audience who watched it, are they guilty or not? It is possible to further extend the questions. However, for the time being we do not have the answers. At this point, we come to the conclusion that we need legal adjustments to comply with the requirements of the internet age.
